This may include:

  • Taking photographs

Where I wish to use identifiable photographs for purposes beyond delivering your photography service — such as my public portfolio, website, social media or promotional materials — I will use an appropriate lawful basis and, where applicable, obtain permission through a model release or image usage consent agreement. Any usage will also be subject to the terms of the relevant photography agreement or release.

6. Children and Young People

Photography may occasionally involve children or young people. Where appropriate, I will obtain permission from a parent or legal guardian before using identifiable photographs of a child for portfolio, promotional or similar purposes. Personal information relating to children will be handled with particular care.

Payments may be processed using third-party payment providers. I do not generally receive or store complete payment-card details where payments are handled directly by a payment provider. The relevant payment provider may process your personal information in accordance with its own privacy policy. I may retain transaction information such as the amount paid, payment date, invoice number and payment status for accounting and business-record purposes.

9. Contact Forms and Email

If you contact me through this website or by email, I will use the information you provide to respond to your message and deal with your enquiry. Your correspondence may be retained where reasonably necessary to manage a booking, maintain business records, resolve a dispute or refer back to previous communications. Please avoid sending sensitive personal information unless it is genuinely necessary.

10. Cookies

This website uses cookies and similar technologies. Cookies are small files or pieces of information stored on your device when you visit a website. Some cookies are strictly necessary for the website to function properly and securely. Squarespace, as the hosting platform for this website, uses necessary cookies to provide and securely operate the website. The website may also use analytics and performance cookies to understand website traffic and how visitors interact with the site. Where required, non-essential analytics and performance cookies will only be used after you have made the appropriate choice through the website's cookie banner. Squarespace provides controls that can restrict non-essential cookies until a visitor has consented. You can manage your cookie preferences using the cookie controls available on this website. For further information, please see the separate Cookie Policy.

11. How I Use Your Information

Depending on the circumstances, I may use personal information to:

  • Operate and maintain this website

  • Respond to enquiries

  • Provide photography services

  • Manage bookings

  • Prepare quotes and contracts

  • Take and edit photographs

  • Deliver completed photographs

  • Process purchases and orders

  • Issue invoices and receipts

  • Maintain financial and business records

  • Communicate with clients

  • Manage complaints or disputes

  • Protect my legal rights

  • Improve my website and services

  • Understand website traffic

  • Display photographs in my portfolio where permitted

  • Promote my photography business where permitted

  • Comply with legal and regulatory requirements

I will not use your personal information for purposes that are incompatible with the reason it was collected unless there is an appropriate legal basis for doing so.

12. Lawful Bases for Processing

Under UK data protection law, I must have a lawful basis for processing personal information. Depending on the circumstances, I may rely on: Contract — where processing is necessary to provide photography services, fulfil an order or take steps at your request before entering into a contract. Legal obligation — where information must be retained or processed to comply with legal, tax, accounting or regulatory requirements. Legitimate interests — where processing is reasonably necessary for operating, protecting and improving the business and those interests are not overridden by your rights and interests. Consent — where you have actively agreed to a particular use of your information, such as certain uses of photographs or non-essential cookies where consent is required.

Where processing relies on consent, you can withdraw that consent for future processing. Withdrawal of consent does not make processing that took place lawfully before withdrawal unlawful.

13. Sharing Your Personal Information

I do not sell your personal information. I may share information with trusted third-party providers where reasonably necessary to operate the business or provide services.

These may include:

  • Squarespace for website hosting and website services

  • Website analytics providers

  • Email providers

  • Cloud storage and backup providers

  • Online gallery or image-delivery providers

  • Payment processors

  • Accounting or bookkeeping services

  • Professional advisers

  • Printing laboratories

  • Product manufacturers

  • Delivery and courier services

I will only share information that is reasonably necessary for the relevant purpose. Information may also be disclosed where required by law or where reasonably necessary to establish, exercise or defend legal rights.

14. International Data Transfers

Some of the technology and service providers used by this website or business may process information outside the United Kingdom. Where personal information is transferred internationally, I will rely on appropriate arrangements or safeguards where required by applicable data protection law.

15. How Long I Keep Your Information

I will keep personal information only for as long as reasonably necessary for the purpose for which it was collected. Retention periods may vary depending on the type of information.

For example:

Enquiries that do not result in a booking may be retained for a reasonable period to allow me to respond to follow-up enquiries. Client and booking records may be retained for as long as necessary to manage the client relationship and deal with any subsequent queries or disputes. Contracts, invoices and financial records may be retained for the period required for accounting, tax and legal purposes. Model releases and image usage permissions may be retained for as long as the associated photographs continue to be used or as otherwise reasonably necessary to demonstrate the permissions granted. Photographs and project files may be retained as part of my photography archive where there is an appropriate lawful basis to do so.

However, Richard Daniel Kavanagh Photography does not guarantee permanent archival storage of client photographs, and clients should maintain their own backups of delivered images. Information that is no longer required will be securely deleted, anonymised or otherwise disposed of where appropriate.

16. Keeping Your Information Secure

I take reasonable steps to protect personal information from unauthorised access, loss, misuse, alteration or disclosure. Measures may include appropriate password protection, secure devices, access controls, reputable service providers and backup procedures. However, no internet transmission, website, cloud service or electronic storage system can be guaranteed to be completely secure.

17. Your Data Protection Rights

Depending on the circumstances, UK data protection law may give you rights in relation to your personal information.

These can include the right to:

  • Ask what personal information I hold about you

  • Request a copy of your personal information

  • Ask for inaccurate information to be corrected

  • Ask for personal information to be deleted in certain circumstances

  • Ask me to restrict how information is used in certain circumstances

  • Object to certain processing

  • Request transfer of certain information where applicable

  • Withdraw consent where processing is based on consent

These rights are not absolute and may depend on the circumstances and the lawful basis on which information is being processed.

To exercise your rights, contact:

Contact@richarddkavanagh.com

I may need to verify your identity before responding to a request.

18. Complaints

If you have concerns about how I handle your personal information, please contact me first so that I can try to resolve the issue. You also have the right to raise concerns with the UK's data protection regulator, the Information Commissioner's Office (ICO).

19. Third-Party Websites

This website may contain links to third-party websites, social-media platforms or other external services. I am not responsible for the privacy practices of third-party websites. If you follow an external link, you should review the privacy information provided by that organisation.

20. Changes to This Privacy Policy

I may update this Privacy Policy from time to time to reflect changes to the website, photography services, products, technology providers or legal requirements. The latest version will be published on this page and the Last updated date at the top of the policy will be changed accordingly.
